A woman in her 30s has been sentenced to a prison term after falsely accusing her biological father of rape, motivated by his refusal to provide her with financial assistance despite having funded her overseas education.
According to a report from the judicial community on the 1st, the Criminal Division 1 of the Namyangju Branch of the Uijeongbu District Court, under the jurisdiction of Presiding Judge Choi Chi-bong, has recently sentenced the woman, referred to as A, to 10 months of imprisonment. The charges include defamation, obstruction of business, and insult.

A's trial revealed she had posted defamatory statements against her father, B, on an online forum 11 times between May and June of the previous year with titles suggesting familial sexual abuse.
In her online posts, A falsely asserted that she had been the victim of ongoing sexual abuse by her father since the age of four and alleged that her mother also endured domestic and sexual violence. She claimed the issue was resolved with a payout of 30 million won and called for severe punishment.
A further complicated her father's situation by disclosing his full name and business details. This exposure reportedly hindered his business operations significantly.
Additionally, A leveled accusations in six separate posts that B had remarried a woman, C, whom he had allegedly been having an affair with.

In February 2021, A initiated a civil suit in the Incheon District Court for damages related to the purported sexual assault, yet she was unable to produce evidence substantiating any illegal actions.
During the criminal proceedings, A maintained the veracity of her statements; however, the court dismissed her assertions, referencing the civil lawsuit's outcome. The court noted the absence of tangible evidence or circumstances corroborating A's claims of habitual sexual abuse by B.
Moreover, the court concluded that A's allegations were baseless, given the financial support she had received from her father during her international studies and after returning, coupled with the timing of her accusation, which followed closely after her request for a large sum of money for a cafe venture was declined.

The court underscored, "Her dissemination of false information stemmed from her dissatisfaction over the withdrawal of financial support, resulting in irreparable damage to the victims' reputations."
The court elucidated its sentencing rationale by highlighting the potential for recidivism due to A's persistence in making similar posts post-offense, and the strong victim advocacy for stringent punishment. These elements collectively informed the sentencing decision.
